TERMS OF SERVICE

OVERVIEW
This website is operated by Nitestore. Throughout the site, the terms "we", "us", and "our" refer to Nitestore. By accessing our site and/or purchasing from us, you agree to be bound by the following Terms of Service ("Terms"), including any additional terms and conditions and policies referenced herein or available via hyperlink. These Terms apply to all users of the site.

1. ELIGIBILITY

To use this website or purchase from Nitestore, you must be at least the age of majority in your country or region. If under the age of majority, your parent or legal guardian must give consent.

2. PRODUCTS & SERVICES

2.1 DIGITAL PRODUCTS – SAMPLE PACKS, ABLETON TEMPLATES, PRESETS & DOWNLOADS

All digital products sold by Nitestore are non-refundable. These products are licensed for individual, non-transferable use by the purchaser only. Redistribution, resale, sublicensing, or public release of the contents (either as-is or in modified form) is strictly prohibited.

By purchasing, you are granted a non-exclusive licence to use the contents in personal or commercial music production. You may not resell or distribute the individual files or content in any form.

Creators providing sample packs for sale on our platform do so on the understanding that they are the rightful owners of all included content, and have created every element themselves or have obtained the appropriate rights, licences, and clearances for redistribution and commercial use. This includes but is not limited to third-party samples, audio loops, vocals, and any other material.

Nitestore operates in good faith and assumes no responsibility for verifying the legal status of each component within a pack. If any sample pack content infringes third-party rights or violates licensing terms, the submitting creator bears full responsibility and liability. Nitestore is indemnified against any and all claims, damages, or legal consequences arising from such infringements.

2.2 ONE-TO-ONE MUSIC PRODUCTION LESSONS (LIVE)

All lessons are delivered live via Zoom and are not recorded. It is your responsibility to attend at the scheduled time. If you need to reschedule, a minimum of 1 weeks notice is required. No-shows or cancellations are non-refundable. Anything outside of this period is solely at our discretion.

2.3 CUSTOM-MADE CLOTHING

All clothing items are made to order and produced specifically per customer request. As such, we do not accept returns or offer refunds. Please check sizes and product descriptions carefully before purchasing.

2.4 TRACK FEEDBACK SERVICE

By purchasing track feedback, you will receive a personalised review based on the audio you submit. This service is non-refundable. Feedback is subjective and offered in good faith as a professional opinion.

2.5 MEMBERSHIP & SUBSCRIPTION AREA (NITESTORE STUDIO)

Purchasing a subscription grants you access to a private members-only area containing digital tools, tutorials, templates, and exclusive content.

Subscriptions are available on a monthly or annual basis and will automatically renew unless cancelled before the end of the current billing period. You can manage or cancel your subscription at any time through your account dashboard - this is accessible at the footer of every page and navigating to the footer menu titled "Your Account", clicking "View My Account" and then going to "Manage Subscription".

Your membership is for personal use only. Sharing login details or redistributing content from the members' area is strictly prohibited. IP addresses, account details and login locations are automatically monitored by our security system. Any suspicious activity, such as account sharing or unauthorised access, will result in immediate account termination without refund. Nitestore also reserves the right to take legal action for unauthorised distribution or misuse of content, including but not limited to copyright infringement and breach of contract.

2.6 SUBTITLES, TRANSLATIONS & LOCALISATION DISCLAIMER

Some content within the Nitestore Studio members’ area, including but not limited to video tutorials and educational materials, may include subtitles or translations provided in various languages for accessibility and convenience.

While reasonable efforts are made to ensure subtitles and translations are accurate, Nitestore does not guarantee that translated or subtitled content will be entirely correct, complete, or free from errors. Automated or third-party translation tools may be used, which can result in inaccuracies, omissions, or misinterpretations.

All content is provided primarily in its original language, and this version shall always take precedence in the event of any discrepancy or misunderstanding arising from subtitles or translations.

Incorrect, incomplete, or unclear subtitles or translations do not constitute a defect in the service and shall not be grounds for refunds, partial refunds, chargebacks, subscription cancellations, or any form of compensation.

By accessing and using subtitled or translated content, you acknowledge and accept this limitation and agree that Nitestore shall not be held liable for any loss, misunderstanding, or inconvenience arising from translation inaccuracies.

2.6 VINYL RECORDS

Digital Redistribution and Intellectual Property Rights:
Any unauthorised copying, redistribution, or digital reproduction of the content contained on these vinyl records is strictly prohibited. The intellectual property rights, including copyrights and trademarks, remain the exclusive property of the label Nitecutz and/or the respective rights holders. By purchasing from us, you agree not to duplicate, distribute, or exploit the recordings in any digital or physical format without express written permission from Nitecutz.

3. RETURNS & REFUNDS

All sales are final. Due to the nature of our products and services, we do not accept returns or issue refunds.

4. PAYMENT & BILLING

You agree to provide accurate and up-to-date billing and contact information. We reserve the right to refuse or cancel orders that appear to be fraudulent, abusive, or intended for resale.

Initiating a chargeback or payment dispute without contacting us first may result in account suspension and permanent denial of service.

5. INTELLECTUAL PROPERTY

All content available on this site—including but not limited to our trademarks "Nitestore", "Niteplan" and "Nitecutz", sample packs, tutorials, branding, graphics, text, and media—is the intellectual property of Nitestore and/or its content creators.

You may not reproduce, distribute, sell, or exploit any part of the site or its materials without express written permission.

6. ACCESS & DOWNLOAD ISSUES

If you experience a problem downloading digital products or accessing membership content. We will make reasonable efforts to resolve the issue.

7. USER CONDUCT

You agree not to:

  • Use the site for any unlawful purpose;

  • Transmit harmful or malicious code;

  • Infringe on the intellectual property of Nitestore or others;

  • Collect or misuse the personal data of other users;

  • Share access credentials or distribute private content;

  • Violate any laws or third-party rights.

We reserve the right to terminate accounts violating these terms without notice.

8. LIMITATION OF LIABILITY

Nitestore shall not be liable for any direct, indirect, incidental, consequential or special damages arising from your use of our site, products, or services. This includes, but is not limited to, loss of data, income, business opportunities or reputation.

All services and products are provided "as is" without warranties or guarantees, except where explicitly stated.

9. INDEMNIFICATION

You agree to indemnify, defend and hold harmless Nitestore and its affiliates, officers, staff, suppliers, and partners from any claims, damages, or legal expenses arising out of your breach of these Terms or misuse of the services.

10. GOVERNING LAW & JURISDICTION

These Terms of Service are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Updates will be posted on this page. Continued use of the website or services constitutes acceptance of the revised Terms.
